Welcome to Artberry. These Terms of Service govern your use of the Artberry platform, website, and services operated by Artberry Tech Private Limited, a company incorporated under the laws of India.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

• Platform — The Artberry website and mobile applications.
• Artist — Any individual or entity offering creative services through our Platform.
• Client — Any individual or entity booking services from Artists.
• Booking — A confirmed engagement between a Client and an Artist.
• Service Fee — The commission charged by Artberry for facilitating bookings.

To use certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept responsibility for all account activities
• Notify us immediately of any unauthorized use of your account

Artberry provides a marketplace connecting Clients with Artists for events and occasions. We facilitate discovery, booking, and payment but are not a party to the agreement between Clients and Artists.

For Clients:

• Browse Artist profiles and request bookings through our Platform
• All bookings are subject to Artist availability and acceptance
• Payment must be made through our secure payment system
• Provide accurate event details and requirements

For Artists:

• Provide accurate information about your services, pricing, and availability
• Fulfill confirmed bookings professionally
• Agree to our commission structure and payment terms
• Maintain appropriate licenses and permissions for your services

All payments are processed securely through our payment partners:

• Clients pay the full booking amount at the time of confirmation
• Payments are held in escrow until the event is completed
• Artists receive payment within 3–5 business days after event completion
• Artberry charges a service fee (commission) on each successful booking
• All fees are inclusive of applicable taxes as per Indian law

Cancellation terms vary based on timing and circumstances. Please refer to our Refund Policy for detailed information on cancellations and refunds.

You agree not to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Attempt to circumvent our payment system
• Use the Platform for any illegal or unauthorized purpose

The Service and its original content, features, and functionality are owned by Artberry Tech Private Limited and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Artists retain ownership of their portfolio content but grant us a license to display it on our Platform.

To the maximum extent permitted by law, Artberry Tech Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Service. Our total liability shall not exceed the amount paid by you to us in the twelve months preceding the claim.

Any disputes arising from these Terms or your use of the Service shall be governed by the laws of India. You agree to submit to the exclusive jurisdiction of the courts located in Pune, Maharashtra, India.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
